Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") govern access to and use of the LOMOPAY platform ("the Platform", "we", "us"), operated internationally.

By creating an account or using any of our services, you ("the User", "you") acknowledge that you have read, understood, and unconditionally accepted these Terms. If you do not accept these Terms, you must not use the Platform.

2. Definitions

• Platform: all websites, applications, and services operated under the LOMOPAY brand.
• User: any individual or legal entity holding an account.
• Services: features offered (AI generation, payments, affiliation, shop, wallet, paylinks).
• Credits: virtual units consumed when using AI services.
• Generated Content: any output produced by the Platform from User instructions.

3. Registration and user account

3.1. Registration is open to individuals at least 16 years old (or of legal age in their country) and to legally constituted entities.

3.2. The User agrees to provide accurate, complete, and up-to-date information.

3.3. The User is solely responsible for the confidentiality of their credentials. Any action performed from their account is deemed performed by them. Two-factor authentication (2FA) is strongly recommended.

3.4. Disposable email addresses are forbidden. Any account created with such an address may be blocked or closed without notice.

3.5. Only one account per person is allowed. Creating multiple accounts for fraudulent purposes results in immediate suspension and loss of any balance.

4. Description of services

LOMOPAY offers a range of services available according to the chosen plan:

• AI Generation: creation of posters, images, and visual content from text descriptions, using third-party AI models (OpenAI, Google Gemini, etc.).
• Payments: collection, transfer, and withdrawal via integrated providers (Stripe, PayPal, Mobile Money, bank transfer, CinetPay, Moneroo, Leekpay, etc.).
• Paylinks: generation of personalized payment links for sales between individuals or businesses.
• Affiliation: rewards for referring other users, at the rates displayed.
• Shop: marketplace allowing sellers to offer products/services and buyers to purchase them.
• Electronic Wallet: internal balance to store funds, transact, and request withdrawals.

The Platform reserves the right to add, modify, or remove services at any time.

5. Credits and plans

5.1. Access to AI services is by credit consumption, provided through the chosen plan or purchased individually.

5.2. Credits are non-refundable, cannot be converted into money, and expire at the end of the plan unless otherwise stated.

5.3. Plans may be one-off or recurring. The User may cancel at any time; the plan remains active until expiry.

6. Payments and billing

6.1. Prices are shown in the selected currency and include applicable taxes unless stated otherwise. Fees may apply depending on the payment method.

6.2. Payments are processed by secure third-party providers. LOMOPAY never stores full banking details.

6.3. In case of payment failure, abusive chargebacks, or suspected fraud, the Platform may suspend the account and pursue legal action.

6.4. Wallet withdrawals may be subject to KYC verification, a minimum amount, and processing times of 1 to 7 business days.

7. AI Generation

7.1. The User warrants that submitted prompts do not violate any law or third-party rights.

7.2. Generated Content is made available to the User for personal or commercial use, subject to the conditions of third-party AI providers.

7.3. The Platform does not guarantee the absolute uniqueness of Generated Content; similar results may be produced for other users.

7.4. The following are strictly forbidden: prompts aiming to generate child sexual content, graphic violence, disinformation, non-consensual deepfakes, hate content, counterfeit brands, or public figure impersonations.

8. Affiliation program

8.1. The program rewards the User for each valid signup generated via their personal link, at the rates displayed in their dashboard.

8.2. The following result in loss of commissions and account closure: self-referral, fake accounts, spam, misleading advertising, fraudulent traffic purchase.

8.3. Commissions are credited to the internal wallet and are subject to the same withdrawal conditions as other earnings.

9. Shop (sellers and buyers)

9.1. Sellers. The seller is solely responsible for the legality, compliance, delivery, and after-sales service of offered products or services. LOMOPAY acts as a technical intermediary and charges a commission on each transaction.

9.2. Buyers. The buyer acknowledges purchasing directly from the seller. In case of dispute, the buyer must first contact the seller; if unresolved, they may contact LOMOPAY support.

9.3. Illegal, counterfeit, dangerous, or public-policy-violating products are strictly forbidden.

10. Electronic wallet and paylinks

10.1. The internal wallet is not a bank account. Funds are held for use on the Platform.

10.2. Paylinks allow Users to collect payments from third parties. Any fraudulent transaction, money laundering, or financing of illegal activities will result in funds being frozen and reporting to authorities.

10.3. LOMOPAY reserves the right to request KYC verification at any time.

11. Prohibited content

It is forbidden to use the Platform for: (a) any illegal activity; (b) distributing hateful, violent, pornographic, defamatory, or rights-infringing content; (c) attempting to compromise Platform security (hacking, mass scraping, bypassing limits); (d) impersonating third parties; (e) money laundering or financing illegal activities.

12. Intellectual property

The LOMOPAY brand, logo, interface, and code are the exclusive property of LOMOPAY. Any reproduction, modification, or reuse without written permission is forbidden.

13. Personal data

The processing of personal data is governed by our Privacy Policy, which is an integral part of these Terms.

14. Liability and warranties

14.1. The Platform is provided "as is". We do not guarantee uninterrupted availability, freedom from errors, or fitness for a particular purpose.

14.2. Our liability shall not exceed the total amount paid by the User over the last 12 months. We are not liable for indirect damages, data loss, loss of profit, or business interruption.

14.3. We are not responsible for the actions of third-party providers (AI providers, payment processors, etc.).

15. Suspension and termination

We may suspend or terminate any account in case of breach of these Terms, without notice or compensation, and may retain funds during fraud investigations. The User may close their account at any time from their dashboard.

16. Changes

We may amend these Terms at any time. The applicable version is the one published on the Platform when you use it. Material changes will be notified by email or in-app notification.

17. Governing law and jurisdiction

These Terms are governed by the law of the jurisdiction where LOMOPAY's publisher is established. Any dispute shall be submitted to the competent courts of that jurisdiction, subject to mandatory consumer protection rules of the User's country of residence.
